I-94 Form Questions

I-94 forms provide arrival and departure dates for certain foreigners used by U.S. Customs and Border protection as well as U.S. Citizenship and Immigration Services (USCIS). The I-94 must be completed before the foreign citizen attempts to enter into the United States. Once the foreign citizen has the I-94, he/she will be admitted into the United States under a non-immigrant status. When the I-94 is presented at the port of entry, a CBP (Customs and Border Protection) officer will stamp the form approving the admission of the foreign citizen for a specified period. Below are a few of the more commonly asked questions regarding I-94 forms that have been answered by Experts.

If an individual has an I-94 for November 2, 2012 and the individual wants to stay in the United States to live and work, how would the individual go about doing this?

The I-94 card controls the length of time you are allowed to stay in the Unites States and also what you are entitled to do while here. The USCIS (United States Citizens and Immigration Services) will allow or deny the extension request. Some individuals may not qualify for an extension. Furthermore, a person cannot remain in the U.S. past the time his/her visa expires. If you have a nonimmigrant visa that provides for a change of status or an extension option, you can use the I-539 form to file for a change of status or an extension of stay and this will be done through the USCIS office. You will need to file for your extension at least one month before your I-94 card expires. If the USCIS grants the extension, you will receive an approval notice with the new status and new date of authorized stay.

If an individual is in the U.S. on a H1B visa valid until Oct 2008 then when returning to the U.S. after a trip the immigration officer stamped their passport with the I-94 valid until Aug 2007, now the individual has a new passport, how will the individual renew the I-94?

1. One way to guarantee a renewal of the I-94 is to cross into Canada and visit one of the many tourist attractions. When you re-enter the United States, you will be able to obtain a new I-94. You will still need to have H-1B packet that you used to get your visa. This must be done before the original I-94 expires.

2. Ask the attorney who originally processed your paperwork to petition the immigration office to issue a new I-94. Whether you are issued a new card or not will be up to the processing center. If your attorney doesn't think your chances of receiving a new card are favorable, he/she may decline from submitting the petition.

3. You can consult with the immigration agents at a port of entry about re-stamping your I-94. You may have a better chance if you go to the port in which you originally entered. There is a chance you will be denied but you will not lose anything by trying and you will not be deported.

If an individual is an Irish citizen and recently married an American citizen, if the Irish citizens visa expires how long will it take to get a marriage visa, also can the Irish citizen be deported even though they are an immediate relative of an American citizen?

Your spouse will need to submit documents in an attempt to gain your legal permanent residence while you are in the United States. Your I-94 is your stay in the U.S. card and it controls how long you are allowed to remain in the Unites States. If you had an attorney to prepare your original documentation, check with him/her and see if they requested an EAD card (Employment Authorization Document) and an Advanced Parole (Travel Document). The approval time on the EAD card can take anywhere from 90 to 180 days and the Advanced Parole can take up to 225 days to process.

I lost my I-94 and had to renew my passport while in the U.S., and now I am out of status. I am leaving the country in a few weeks, what exactly happens when I go to the airport?

What happens at the airport will be up to the officer who handles the situation. If you have overstayed your visa due to the replacement of your I-94 and passport renewal, there shouldn't be much of an issue. The officers will ask you a few questions regarding why you have overstayed. You should have the proper travel documentation that shows you have filed for a replacement. You should contact the USCIS and file for an extension or a voluntary departure.

My I-94 expired on February 2005. Is there any possibility to become legal in U.S.A.?

To hold a legal status in the United States you would have to be here under a valid visa. You need to consult with a local immigration attorney who can assist you and try to work something out with INS if your goal is to remain in the United States.
