Arson Questions

Arson is the malicious act of setting fire to homes, buildings, vehicles, wilderness areas with the intent of causing destructive damage. Generally, these acts can be distinguished from natural occurring fires such as combustion or lightning strikes. The majority of arson cases involve intentional fires being set to gain insurance compensation from the structures. Below are a few of the more commonly asked arson questions that have been answered by Experts.

One of my rental properties was set on fire deliberately. The insurance company has been authorized to make payment on my claim, which was contingent on their own investigation and the final report from the local fire department. Now, after the fact, the fire department is calling for me to come down for a two hour interview. Do I have to meet with them and answer any questions?

If the fire department has requested the interview, you are not required to go. Furthermore, if you choose to go to the interview, you should speak with an attorney first, or take an attorney with you to protect yourself from making comments that may hurt you later on. While the fire marshal has said that he would like to speak with you, anything that you say will be part of his final report. During the interview, if you were to say something that the fire marshal could use against you to prove arson, those statements may be used against you.

While you want to cooperate with the fire department, you shouldn't put yourself in a situation that may cause issues at a later date.

The fire marshal probably wants to close the case and just needs information from you to do so. If this is the case, that is fine. However, if the fire marshal has suspicions that you had something to do with the fire and wants to label the fire as arson, you should have an attorney present for the interview.

Your attorney may be able to contact the fire marshal and find out what the interview will entail. This will help determine whether or not you are a suspect of arson. If the fire marshal wants to close the case, your attorney can decide whether or not you should meet with the fire marshal.

What are the Ohio arson Statute of Limitations?

There is an entire chapter dedicated to arson and similar offenses in the Ohio Revised Code 2909. Different types of arson carry different statutes of limitations. You will have to figure out which arson you are looking for. Is it "aggravated arson"? http://codes.ohio.gov/orc/2909.02 or is it "arson"? http://codes.ohio.gov/orc/2909.03.

Depending on the type of arson in question, the value of the damaged property, and whether or not the person has avoided prosecution can extend the length of the statute of limitations. Generally the statute of limitations is 2 years up to 20 years http://codes.ohio.gov/orc/2901.13. There is the possibility of other crimes being involved with the arson that would carry other statute of limitations that may allow prosecution beyond the statute of limitations for arson.

My teen age son was charged with arson 3rd degree and burglary 2nd, he set fire to an abandoned house, he got scared and called 911 and is remorseful. What should I do?

Because both of these charges are Class C felonies, you should find an attorney to represent your son. You may be eligible for a public defender if you are unable to afford on. There is a possibility that due to the building being abandoned and no injuries occurred from the arson, your son may beat the charges.

Why is arson hard to investigate? What "special" difficulties can occur when trying to prove an arson case?

Arson is hard to investigate because the cause of the fire must be proven. When investigating a fire, the investigator must figure the cause of the fire by determining if there was intent and motive for the fire. Finding the source of the fire takes a skilled fire marshal.

Several problems arise when trying to investigate a fire. Some of these problems are no fingerprints, no witnesses, and the arsonist has usually already left the scene before the fire draws attention. Usually, if there are fingerprints at the scene, the soot from the fire has covered them.

While a fire marshal can usually determine arson, without motive such as insurance fraud, it is hard to get a conviction for the crime.

Arson is not only a crime; it has the potential to harm people within the area of the fire.
