For the 2011 tax year, only specified individuals are required to file Form 8938 with their Form 1040. Entities such as corporations, S corporations, partnerships, trusts and tax-exempt organizations are not required to file Form 8938 with their 2011 tax returns. Currently no domestic entity is required to file Form 8938 until the regulation is finalized. The U.S. Treasury and IRS anticipate issuing a final regulation during 2012 to be effective for specified domestic entities’ tax years beginning after December 31, 2011.
The temporary regulations list the Specified Individuals Required To File Form 8938, which include:
S Corporations are not listed as a specified Individual.
Note, the S Corporation is required to file Form TD F 90-22.1, Foreign Bank Account Report (FBAR) which is due June 15th 2012.
