I plan to file my tax with a with holder for my daughter who

Resolved Question:

I plan to file my tax with a with holder for my daughter who has not been able to work since 2009 due to physical and mental problems according to a letter sent to me by her doctor (MD).
I am a widower and receive a monthly fee from the VA @ 100% rate. Do I need any other paper work?

Stephen E. Grizey :

Hi & thanks for using our service. I'll do my best to give you a complete & accurate answer. Please ask me to clarify anything you don't understand.

Stephen E. Grizey :

What do you mean "holder"? How old is your daughter and does she live with you? Is she single?

Customer:

meant to type "form"

Customer:

last year filed 1040 A

Stephen E. Grizey :

are you talking about your return?

Customer:

yes

Stephen E. Grizey :

What are you asking? There is no "form" for your daughter.

Customer:

I plan to file form 1040 A status as box 4 head of household with qualifying person

Stephen E. Grizey :

Can you answer my other questions?

Customer:

My daughter ,is 47 yrs old, is single, gay, and lives with another gay woman who has become her "partner" which is not federally recognized. They live in Califormia

Stephen E. Grizey :

You can't use head of household filing status unless she lives with you.

Customer:

How should I file?

Stephen E. Grizey :

Well, since you aren't married you would file as single.

Stephen E. Grizey :

Are you certain that her partner isn't claiming her as a dependent since your daughter lives with her?

Customer:

Then how can I claim the suport I am giving her?

Customer:

yes...she can claim her on her state income tax, but not federal

Stephen E. Grizey :

No. I think you must be referring to filing a joint return.

Stephen E. Grizey :

If she can claim her as a dependent on her CA return, she would be able to claim her as a dependent on her Federal return; it is only the joint return issue that is different.

Customer:

Probably her partner is filing tax forms

Stephen E. Grizey :

Are you furnishing more than 1/2 of her support.

Customer:

NO

Stephen E. Grizey :

Her partner is filing tax forms?

Stephen E. Grizey :

If you aren't paying 1/2 her support you can't claim her as a dependent either.

Customer:

any other way to claim her or the support i am providing her?

Stephen E. Grizey :

No.

Stephen E. Grizey :

Are you paying income taxes yourself? Do you have other income?

Customer:

Can I expense it out under any other expense area?

Stephen E. Grizey :

No.

Customer:

O K

Stephen E. Grizey :

I know it seems unfair, but there''s really nothing you can do based upon the situation you describe.

Stephen E. Grizey :

Is she receiving social security disability?

Customer:

Thanks NO

Stephen E. Grizey :

Was she ever married?

Customer:

no

Stephen E. Grizey :

I'm just trying to cover all angles

Customer:

thanks appreciate

Stephen E. Grizey :

Does she have any children?

Customer:

no

Stephen E. Grizey :

too many no s

Customer:

just two huskies she considers kids

Stephen E. Grizey :

Has she worked in the past?

Customer:

she has a car in her and my names

Customer:

yes she had a job that paid good

Stephen E. Grizey :

Why doesn't she apply for Social Security disability?

Customer:

she has, but they keep losing her applications

Stephen E. Grizey :

If her doctor feels she has debilitating physical and mental problems, that's a good start.

Customer:

I realise that....

Stephen E. Grizey :

I don't buy that...........sounds like a story to me; that just doesn't happen; she can go to the SSA office and the application will be completed for her;

Stephen E. Grizey :

that's the law

Customer:

O K I'll tell her..

Stephen E. Grizey :

CA has many, many mental health advocates & if she is getting counseling, they will arrange to accompanying her

Customer:

Sounds like something she can do

Stephen E. Grizey :

If not, she would qualify for Medical, which is CA's low income health insurance which covers everything; you can't buy insurance as good as that

Stephen E. Grizey :

In this country, you have to be rich or poor; the rest of us pay.................

Customer:

Her partner hass insured her under her insurance and is very good

Stephen E. Grizey :

OK, I understand; that's about all the ideas I have

Customer:

I appreciate Can I print this conversation?

Stephen E. Grizey :

Sure, I think you have to block it off or highlight it and then hit control print; that's one way
