Resolved Question:

My husband passed away in october 2009. I received a K-1 for some money that I received and which went into a separate bank account set up for his estate. What form do I use to report the K-1. I was told that I had to file it separate from my personal taxes and have already filed my personal tax return.

Wallstreet Esq. :

Hello I am a licensed attorney here to help you with your question, please review my response and do not hesitate to ask for clarification.

Wallstreet Esq. :

Was the k-1 in your name?

Wallstreet Esq. :

Why did you put it into the Estate account?

Customer :

I was told by the attorney for the business that the check had to be made out to his estate so I set up a separate bank account for the Estate of xxx x xxxx (my husband's name).

Customer :

The K-1 is in the name of the Estate of xxx x xxxxx.

Wallstreet Esq. :

It would be reported in the Estate tax form not yours as it is part of the Estate.

Customer :

So how do I go about filing an Estate tax form? Which form is that?

Wallstreet Esq. :

It is fairly simple go to the link above and use the IRS FORM 706, the k-1 would be listed their.

Customer :

Thank you.

Wallstreet Esq. :
