my husband and i purchased a home in aug.09 we file our taxes married but separte can we both claim the home or one of us.

Assuming you otherwise qualify, the max credit each spouse can claim of a MFS return is $4K. So, to achieve the entire $8K, you would both need to claim the credit if filing on separate returns. Please let me know if you have further questions.
