We pay individual therapists to come into our home to treat

Customer Question

We pay individual therapists to come into our home to treat our disabled son. This does not support any trade or business we are in, but is a personal medical expense. Do we have to 1099-misc the therapists, and if we don't have to, does that affect our ability to take a medical deduction for the expense (subject of course to the 7.5% AGI hurdle)?

If you just paid for service - you do not need to issue 1099misc form.

You do not have to issue a Form 1099-MISC since you are not making this payment in the ordinary course of your business.

It also does not affect your ability to take medical deduction. You can deduct the medical expenses you pay for treatment of your son to the therapist and of course the deduction will be subject to 7.5% AGI floor.
