Under current law, the capital gains tax rates are not scheduled to increase in 2009. However, the new administration may pass legislation that increases the rates for higher income taxpayers (possibly those with AGI in excess of $200,000 - $250,000). In my opinion, any potential income tax increases will be delayed until 2010 or later due to current economic conditions.
