My wife hasn’t received one W-2. What is the legal cutoff date to receive a W-2? When is the employer liable?

By law, W-2 forms must have been postmarked by Jan. 31st. If it is not in the mail now, the employer is in violation of the law.

If an employer fails to file the W-2 forms by the required date, it is subject to a fine for each form filed late.
