Yes. They have the right to give you a 1099 and a w2 for work performed. For example - you work frying french fries for a normal wage. For this, you will receive a w2. You also work and clean the parking lot after the store closes. For this, you receive $300/month and you get a 1099 for this.
This is acceptable and legal.

If you work there with the agreement that you will be paid by 1099, you need to realize that you will be responsible for filing your taxes quarterly and YOU will be responsible for paying the part that they would normally pay. YOU will have to pay your SS, FICA, etc.
If you are an hourly employee, you should not be paid by 1099. If they do not yet have their accounting system set up, they should not hire employees until they do.
I would evaluate my money situation and see if my hourly wage is worth it.
