Capital Gains Hardship for the Unemployed

Customer Question

I have lost my job and can't afford to keep my townhome, will I have to pay capital gains on the money that I make on the sale? I bought my townhome on December 17, 2004. I have been unemployed since March. Thanks.

Your only potentail tax would be on the net gain. Net gain is sales price less commissions, etc minus cost + improvements. Additionally, you may be able to exclude some portion of the gain due to your change in financial position. The excludable portion would be $250,000 * number of days you owned/lived in the house / 730. The $250,000 would be $500,000 if you are married filing jointly.

Just to clarify,

$250,000 * 180 days = 45000000 /730 = $61,643.00 Is the $61,000 amount the amount I have to pay capital gains tax on OR is that the amount I am able to claim an exemption from the captial gains tax? When I was employed, I made $100,000, what is the capital gains percentage on that salary??

It does apply in Florida. $61,643 (based on your calculations) would be the amount of gain that is exempt from tax. In other words, you could make up to $61,643 of gain on the sale and not be subject to any tax.


The actual potential tax will be based on your actual other income in the year of sale. If you sell the property this year and you had $100,000 of income this year (excluding the sale), your tax rate could be as high as 33%. Since you have owned the property less than one year, any taxable gain would be taxable as a short term capital gain - at your ordinary tax rate (33% in this example). However, based on your other information, it would only be the gain in excess of $61,643 that would be subject to tax.
