If you were legally separated the last 6 months of the year, you both have the option of filing as single. You can also claim head of household if you have a qualifying dependent.
If the glitch from last year caused you to have a balance due, the IRS will garnish this year's refund to cover the debt. They will give you what is left over after they do.
