Filing jointly but state taxes from 3 states

Customer Question

Last year, I worked in Maryland from 2/1 to 8/1 and got laid off. I was commuting to Maryland from Massachusetts where I live and my wife works. During my stay in MD, I had my pay stub sent to an address in Virgina for 2.5 months and to MD for the other 3.5 months.
I have W2 that has state tax deducted from VA and MD.
I think I could file married jointly in MA and file jointly as non-residents in MD. I want to get my tax back from VA. Does this sound right?
What advice do you have?

It all depends on if and how long you lived in VA. You must answer this foolowing question. If it is true you will be given a chance on the form 763 to subtract your income from another state. they are primaraly concerned with income from VA. Let me know if you don't understand.


Filing as a nonresident: A part-year resident who lived in Virginia for 183 days or less during the taxable year can file as nonresident on Form 763. As with a resident filing, the nonresident filing allows the individual to claim the full personal exemption and standard deduction amounts

Reply to Vickie Redmond's Post: I lived at a friend's place in VA and never really stayed there for more than 3 days at a time. I travelled in my job and also always came to MA to my home on weekends. I did not realize at that time that my office needed an address to send the pay stub (and deduct state tax). If I pay state taxes to all three states as residents in MA and non-residents in MD and VA, I will be paying quite a bit more. Since I never intended to move to VA, can I not ask for refund from VA.

I am already seeing that I have to pay extra in both MA and MD. Let me know what you think?

And you should get all your money paid to VA refunded.
