I am an spanish attorney
The owner who does not want to change them could go to the metting whre the agrement will be taken and to make opossite to the decission
If the agrement is taken, the comunity will be forced to change them BUT the person who made oposition to the agrement will have no to pay a penny at all
So if somebody votes no to do it he can no be forced to pay, even when if the majority decides to do it the comunity have to do it
This does not relate to my problem. Please understand my problem.
I get it
Its the agrement taken ?
Have you vote it ?
There are NOT law to force the change
I have supplied the correct information to you. It explains the situation clearly
The change will be compulsory only if the majority decide it
Why can two other be allowed to have carports but not me?
If the majority takes the agrement, it will be compulsory, BUT the person who votes againts it have not to pay
So, be carefull about it
No one else has to pay. I pay for what I want
If they do not want to change, they can no be forced to make it, even if you pay
You can no force them if they do not want, even if you pay
It's me that wants to build the carport. I am paying. Two others have done the same so why can I be refused?
If somebody has make it and its done it, you can done it even if they do not allow you, because you can appeal that they have agree with the others
So, if some of them are done it now, and they have no force them to take them out, make yours
That's what I thought but they say it's because the others are in a different position in between the properties. Mine is just at the side of my property
Its right now. You can do it
If they let to the others you got the right to do it
They say it's community land and even though they have given permission to others they must vote on my request but say they will vote against
They can no use the law only with you
Amd they have no chance to go againts the others
So, you got the right to do it
Could you write me something for our administrator in Spanish explaining the law and my rights. I will give it to them before our AGM on Friday next week. I will also advise the president because I should not have to ask for a vote.
I am going to transate it for you
My client can be the chosen works while the community has allowed it to other neighbors, being these consolidated works. The community cannot go against their own actions and if allowed by u omission action works to other neighbors cannot deny it to my customer
I think so but my area is different as it is at the side of my building and not in between.
Its harder to do it but its just the same
OK I hope the administrators agree and correctly advise the president.
I am going to provide you jurisprudence about it
The idea its just the same The comunity has to accept that they have allow in the other cases
