Good Day. I would like to know if a company can refuse to payout your performance bonus when you have resigned. The company own me 10 months of bonus refusing to make a payment.
Optional Information: Province: Gauteng Already Tried: I have called the Directors and every time they said they will come back to me. I have send Emails without reply.
Good day Sir!
Well if the payment of a bonus was a term of your contract then you have a legal right to claim same.
My Advice: Instruct an attorney who specialize in litigation to write a letter of demand to your ex- employer claiming the said amount failing payment you may proceed to instruct your attorney to issue summons against the company. In my opinion this is no longer a labour matter but a civil case.
This answer does not create an attorney-client relationship. Please consult a local attorney in person for legal advice. This information is being provided so you can better discuss legal matters with your attorney.
Thank you for your question and if you feel that I have been of assistance kindly accept my answer.
