If the surviving divorced spouse remarried - he/she is NOT eligible for surviving benefits. But if the second marriage ends - he/she might be eligible for surviving benefits based on divorced spouse working record.

If you have a surviving divorced spouse, he or she could get the same benefits as your widow or widower provided that your marriage lasted 10 years or more.

Benefits paid to a surviving divorced spouse who meets the age or disability requirement as a widow or widower won't affect the benefit amounts your other survivors will receive based on your earnings record.Note: If your surviving divorced spouse remarries after they reach age 60 (age 50 if disabled), the remarriage will not affect their eligibility for survivors benefits..I appreciate if you take a moment to rate the answer.Experts are ONLY credited when answers are rated positively. If you still have any doubts, need clarification - please be sure to ask.I am here to help you with all tax related issues.
