Social Security Questions? Ask a Social Security Expert
Hi Larry. I'm PDtax, and will assist.
There are several different types of collection and garnishment. Can you clarify the kind of debt you are asking about?
Also, clarify the type of benefit you receive from social security, as rights are different, depending on the type of benefit.
Social security can be garnished for federal income taxes to a maximum of 15%.
In addition, from SSA:
"We can withhold Social Securitybenefits to enforce your legal obligation to pay child support, alimony or restitution. State laws determine a valid garnishment order. "
Those are the only attacks at the source that are allowed. Judgment creditors can pursue your benefits once deposited in a bank account, but your benefits are typically protected from things like credit card or other consumer debt judgments.
Thanks for asking at just answer. Positive feedback is appreciated. I'm PDtax.
