How do you have to be married to your second wife to receive

Customer Question

How long do you have to be married to your second wife for her to receive your social security after you are dead, if your first wife is remarried ?

Thank you for your question. Please permit me to assist you with your concerns.

In this situation it does not matter at all if the first spouse is remarried. What governs is if you both are married to one another at the time of passing. Generally speaking a spouse is entitled to receive benefits if married to you for 10 years or more IF divorced, but if married, that spouse is entitled to receive the benefits outright.

Sincerely,

Dimitry, Esq.
