I'm 66 years old and I have a dispute with social security in regard to my working and drawing benefits. I called them last February told them how much money I made on my w-2 and s.s. benefits,I ask them if I needed to stop my social security. If I had made too much money. They told me since I turned 66 before April 15,2012 I could make up to 38,000 and be okay. I then called the IRS and ask them the same questions. They gave me the same answers. Now I have a letter from them saying I made too much and they are going to take my Social Security,from August,20123 untill September 2013 because I owe them 7,000 dollars. I wanted to go to part-time because My totally disabled son died and I'm getting too tired to work 80 hrs in 7 days . I cannot live on that,without my social security. I need to file an appeal they sent me the forms but they make no sense.

Hello and and thank you for your question. For over 34 years, I have answered questions just like yours. And I look forward to assisting you. You do need to file an appeal but they may have not sent you the right form. The form you need is called Request for Waiver of Overpayment. On that form, in your own handwriting, you simply say that both the IRS and SSA gave you wrong information. And it is unfair for you to have to pay the money back. Upon receipt, the SSA will have you come into the office to review your request. And if they do not grant it, you will be given another form known as request for a hearing where a judge will decide your request. And likewise, I have been doing this for over 34 years. And in your case, if it does go as far as a hearing,the judges are most compassionate. So fill out the right form and bring it, don't mail it, to the SSA.

Since I live in S.D.where or which office should I file this through? I gotten forms and letters from 3 different s.s.centers,how do I find out the right place to go they did send me the wrong form.

Any office can accept your filing and your request will then be sent to the office closest to where you reside. Likewise, you can request the forms from any office.
