it disingages but continues to run not turning motor

Have you checked the flywheel teeth the starter gear engages? You may have a section of the flywheel that is missing teeth, which lets starter kick out.

flywheel not missing teeth nor has a damage space..is a older unit so I am shure it has wear...

Is battery voltage at least 12.5 volts?

13.9 ....no the bendix bushing was woren out let the drive flop on the shaft

Then from that, I would suspect you have a defective starter. There is no reason for a starter to drop out while still being engaged. The rotational speed has to keep the spring loaded gear thrown out. That is not happening, the spring is pulling the gear back.

well after being a mechanic for 50 plus years...I agree...time to take two starters and make one..for I doubt I have warranty on the new one
