Should they be treated as adults and be sent to adult court or should they receive treatment and services in juvenile court in an attempt to rehabilitate them? Based on your reading of the inconsistencies in juvenile age and responsibilities throughout the country, U.S. Supreme Court arguments, and scientific evidence on brain development of juveniles, how is this inconsistency likely to be resolved in the 21st century?

What is restorative justice? Discuss the seven core values that characterize restorative justice and whether or not restorative justice is a better solution for juvenile offenders. In your response, discuss whether evidence based programs support the efficacy of restorative justice as a solution to juvenile crime.

With the advent of the “get tough on crime” phenomenon, many states have given to the prosecutor the discretion to determine which juveniles should be tried in adult court rather than allowing it to be the decision of a jurist after careful consideration of the individual factors delineated in Kent v. U.S. at play in the life of each youth. Provide the history of how this occurred and discuss the disadvantages that this process engenders for juvenile defendants. Lastly, identify actions that can be taken by the community to restore to judges the decision of whether or not to transfer a juvenile to adult court.
