Family, advice required on the common law couple living

Customer Question

Family, advice required on the common law couple living together with 2 kids. We have a joint name Mortgage although I was told to leave home to go to my mums due to very bad relationship breakup. I managed to get homeless flat with 3 new carpets and A Cooker!
I havent asked or received any maintenance towards kids as he said I get child benefit for both. We made a mutual agreement at start, we have shared access with kids, 5 nights staying here then on his days off, 3days +1 night stay with dad. However hes now sayin that I dont deserve any maintenance as i dont have kids full-time and in fact I should offer him some money....what??? I have M.S AND MY DISABILITY is stopping me working in my part-time job. i dont understand benefits, my legal rights or where to go now.

Thank you for your question.

You are being intimidated by your ex and must stand up for yourself. Your duty is to claim maintenance for your children. How much is his take home pay and how many nights a year will they spend with him based on the current contact arrangements?

Based on that he should be paying £45 per week in child maintenance.
