I have a flat in Scotland a leak in the flat above has caused the ceiling to collapse in the kitchen this happened before about 18 months ago and my insurers paid out will I have any recourse against the owner of the flat above this time I believe the flat is empty

You will have recourse against the owner of the flat above if you can establish that the owner was negligent. Can you establish the cause of the collapse? If there is a problem that the owner knew or ought to have known could have caused damage to your property then you have a claim.
