am i entitled to any monies from the estate
Optional Information: Province/Country relating to question : scotland Already Tried: nothing
Hi
Thank you for your question.
I have looked at your previous question and I assume that you are enquiring as to whether you would be entitled to any money from that estate.
If there was a will and you are not included you would be entitled to nothing I am afraid as you were not married. If there is no will you can apply to the court under terms of The Family Law (Scotland) Act 2006 section 29. This allows for a cohabiting partner to apply for a payment of a capital sum from the estate of the deceased and for the transfer of property. There are however very strict rules about cohabiting and the court will look at all the circumstances. I suspect that given that you say you only cohabited at weekends and holidays that you would be likely to be unsuccessful, but that is only my opinion based on the very limited information that I have about your circumstances. Any application should be made within six months of death.
I have included a link to the section below for you to read it.
