Do HOAs have the right to tell condo owners whom and how

Customer Question

Do HOAs have the right to tell condo owners whom and how long someone can live in their home?
JA: Because real estate law varies from place to place, can you tell me what state this is in?
Customer: Tennessee
JA: Has any paperwork been filed?
Customer: No
JA: Anything else you want the lawyer to know before I connect you?
Customer: The bylaws state it must be a single family. An owner rented to three school teachers, all women, and the board members made them move. There are other situations as well.

As a general rule, an association may adopt rules and regulations regarding non-owner residency and renting out of units.

So, long as they are not enforced in a discriminatory manner and were duly adopted in the bylaws or covenants, they are enforceable.
