The seller breached his contract with me and finally returned my deposit 69 days later (I just got it today) Can I cash the check and still file a breach of contract against him?

Unless the contract states otherwise or you have signed a release, the refund of your deposit would not affect your claim for breach of contract. So, cash the refund check and you will still be able to assert your claim.
