THe only reason you would need these licenses is if you are in the constant purchase and sale business of existing houses. For one transaction like this, the Cash LLC should enter into an agreement with the developer for a construction mortgage and this can all be written up and prepared by a local lawyer who has experience in construction law and contracts. I cannot give you a statute or code section because one does not exist -- which means that in order to do this, it is perfectly legal. My suggestion here is that you speak to a local attorney in your area who handles nothing but real estate and construction documents and you will be good to go in getting to work on the development that you all want to build. After that, the people with the brokers licenses must come in to sell the units when they are completed.

If this is a standalone transaction and you have no intention of becoming a mortgage lender, then you do not need a mortgage originator licence to invest the money into a real estate project. A broker is one who obtains loans for others. Your LLC is a real estate investor/lender. The loan that you have described is a commercial loan between individual commercial entities (LLCs).
