My neighbor has a very dirty birch tree which is growing over the property line. The township said I could cut anything that crosses the line. My question is can I be sued if the tree dies as a result of it being trimmed to much.

While the law allows for you to trim the tree, you must exercise reasonable caution in trimming so as not to unduly harm the tree. So, can you be liable if the tree dies? Yes, if you do not exercise reasonable caution when you trim the tree and it dies as a result of the lack of reasonable caution. Otherwise, no.
