WE purchased a house. Appliances were listed with the house.

Customer Question

WE purchased a house. Appliances were listed with the
house. They were also on the seller disclosure statement that we signed 5 days after the purchase agreement which did not include or exclude them. Our agent and we believed they were part of the deal.
We moved in and they were gone. Can we make a claim against the owner, RE agent or selling agent?

Dear Customer,The claim would be a "breach of contract" claim - but it would be against the seller, not their agent. Most real property sales agreements also have a "mediation clause" in them - you say that you have already filed suit, so this may be a little too late, but I would recommend checking your contract carefully and seeing if there is such a clause requiring mediation first.
