Your next door neighbor is trespassing on your land. You need to start by sending them a letter informing them that their fence is on your land and that if they do not remove it, you will remove it from your land and sue them for the cost of removal. If they refuse to respond to your demand, then you have two options. First, you can just sue for trespassing and a court order to them to remove the fence. Second, you can remove the fence and sue them for the costs of removal of the fence. Either way you can get rid of the fence off of your property.
