county road annexed by city several years ago has been partially developed but not legally closed.
the remaining section of county road provides access to my existing driveway.
It is currently being platted for developement.
texas code states that "a county road does not have be legally closed if abandon for 20 years".
This county road is currently being used for trash pick up and mail delivery. it is also maintained by city.
Can a developer build on a county road that has not been legally closed?

No, under Texas law, a developer cannot build on a road that has not been legally closed. That is simply not permitted. The government will have to close the road then transfer the property for development.
