Ok so there is a chance she may get a bank loan in the next month or so, so can I make a 3 month extenesion on that balloon note? Just to let the bank loan play out and if nothing happens proceed with the suit?

Yes, you can agree to modify the note to extend it for a three month period and still preserve all your rights under the note. There are no legal issues preventing that. :)
