Customer Question

We purchased a house 2.5 years ago in Lake Havasu City. We had much landscape work done in our backyard including having 7 beautiful trees installed within 5' feet of our back wall. The neighbor came into our yard and cut all the trees down claiming that 5' of our yard is his property even though he allegedly installed the block wall years ago. Is there anything we can do?

Do you have a survey showing the trees were on your land?

If the neighbor has in fact entered your property to cut down trees he is trespassing. Further, under Arizona law he is liable for the damage to your trees. http://www.nolo.com/legal-encyclopedia/arizona-laws-neighbor-property-disputes-65218.html. Do you buy any chance have a survey or title insurance policy from when you purchased the property. The law enforcement agent is not giving you accurate information with regard to this civil matter.
