I am in negotiations on a commercial lease

Customer Question

I am in negotiations on a commercial lease for space for a small business. The lease contains a waiver of the homestead act. Is this common and should I decline?

Hello. My name is***** will be happy to answer your question.I am sorry to hear about this unfortunate situation.Generally, homestead act only applies to residential property, so it is common practice to include a waiver of any rights under homestead act in a commercial lease and generally such waiver does not have any effect on the rights of the commercial tenant.I wish you the best of luck!
