1. Can I force the property owner to build a driveway to comply within the legal easement area and stop them from using the current portion of the driveway not included in the legal document dimensions?
After 30 years that is unlikely. The courts take time into consideration and here if the owner was utilizing the wrong part of the easement, the courts may consider them as obtaining rights to that property via a prescriptive easement
(essentially a right to an easement via adverse possession
), or via an easement by necessity. You can attempt to pursue this and push for the move, but if they can show the courts that they utilized that land constantly and openly, the courts would likely side with them and not require them to build the driveway at this point.
2. A telecommunications company has expressed interest in building a cell tower on the property behind me. Can the owner of the deed of easement give permission for use of my driveway to access this cell tower?
As it would be a 'public utility' build, such use would not violate the easement restrictions. However, since the property is still ostensibly yours, and the travel would not be simple ingress/egress, the company should request permission from you directly--the easement use appears to be personal and that means that you could deny access to someone wishing to traverse your property without first requesting such rights from you directly.
