a vehicle is parked on the street next to the owners home. It is not blocking a driveway or stop signs. hoa wants the vehicle be moved. can these rules override city or state laws?

Is there anything in the bylaws, rules and regulations that state parking on this road is a violation?

i am not sure, i think so.

They can only enforce rules that are stated in the bylaws, rules and regulations. Unfortunately HOA's have the authority to issue violations on the streets within the HOA community. These streets are considered private roads and are owned by the HOA.

Check the rules and regulations, if this is not in the rules or regulations they have no authority to ask you to move the vehicle.
