My home is presently in foreclosure in Florida. Today I received a notice of dropping defendants from the banks attorney. The defendants names that were dropped we're "The unknown spouse of (ME) aka, (my name); and "The unknown spouse of (MY WIFE) aka (her name); and tenant #1 and tenant #2....Does this mean they are dropping the foreclosure? Did they just drop my wife and I from the foreclosure?

Hello and thank you for asking your question. My name is XXXXX XXX I will be assisting you. Those "defendants" are named at the beginning of the suit, before the plaintiff actually knows whether these parties exist. When it is later determined that there are no other parties that they may not have included, the unknown parties are dropped. You and your wife are still parties to the suit, assuming that each of you are named defendants. All that has been done was to drop unknown parties (who are no lo longer unknown and who do not exist.
