Hi - I am a landlord in rural Virginia. Lease states tenant is responsible for care of lawn, including flower beds and keeping grass cut in a couple other small areas. He is not cutting the lawn in its entirety, and has not touched the flower beds or other areas that lease states are to continue to be maintained. With advanced notice, can I apply the cost of having someone else do the yard work to his rent? And if so, if he does not comply, can costs be deducted from his security deposit?
Optional Information: State/Country relating to question: Virginia Already Tried: In July threatened him when he had not cut it for over a month - if he didn't cut it within next 48hrs I would have someone cut it & apply the cost to his rent. He cut it to point that it looked decent from road. (I live 3.5 hrs away). 3.5 weeks later it was looking bad again from what folks could see from driving by. Sent message 7/23 - told him i was aware grass was out of control looking as if no one lived there, therefore from now on someone else would cut it, cost being applied to his rent
You need to give the tenant 30 day written notice to cure their breach of the lease and in the notice you need to inform them that failure to cure the breach will result in possible action for eviction or in you paying to have the work done at the expense of the tenant. If he does not pay you can sue for the money or you can keep it from the security deposit and you can also evict him for breaching the lease and refusing to cure the breach upon receiving the 30 day notice.
