I bought a timeshare with my father in 2010. We tried to use it in 2011 and we were very disappointed with the results. It was very frustrating process and ended up not being able to use it at all. We decided it was not worth the money and want to terminate the contract, sell it back to them or any other mechanism we can use to get rid of this timeshare. We paid for 12 moths and then stopped paying, after the disappointing experience. The managers of this timeshare are adamant about us owning this timeshare and that we have to continue making payments whether we use it or not. We are willing to leave behind the deposit, plus the 12 moths we paid without getting any title. We just don't want anything to do with this. What legal mechanism do we have to get rid of this timeshare?

Unfortunately, to get out of this contract you signed you will have to prove they somehow breached the contract with you. If they did not comply with the terms of the contract you signed when you used the unit in 2011 and they will not correct the problems, then you would have to sue them for breach of contract and would need the court to find that they did indeed break the contract with you, which would be grounds for you to terminate the contract. Unless you can prove breach of contract I am afraid, you would remain bound to this contract you signed and you would need to find a way to sell the unit on your own or through a reputable time share resale company you have verified through the Better Business Bureau.
