I am in an underwater mortgage. My house is falling apart

Resolved Question:

I am in an underwater mortgage. My house is falling apart around me. There is now black mold. I am on full disability and my husband is unemployed. My parents who are in the midst of a divorce and have depleted their funds on medical costs are signed on the loan. I need OUT! What can I do?

WebLaw :

Welcome to JustAnswer,

So sorry to hear of this dilemma. If my answer is not clear to you or does not fully answer your question, please ask me for clarification by using the reply button.

WebLaw :

When you say you "need out" do you mean want to walk away from the house? Do you want to know what will happen if you do walk away from the house?

Customer:

I need to walk away but without ruining my credit making it impossible to find an apartment or future employment. Re-mortgaging is not an option. I have an excellent credit rating, but this house is killing me (literally and figuratively). There must be some agency or organization willing to help me.

WebLaw :

I understand. There is not a government agency that will refinance the house. That said, you may consider renting property prior to defaulting on the mortgage

WebLaw :

You can also consider attempting to modify the mortgage. However due to the black mold and the condition of the house, it may not be in your best interest to do so

Customer:

This isn't giving me any new information. I think what you are saying is that I amstuck with a choice of defaulting on my mortgage and ruining my future or dying a slow death from health issues.

WebLaw :

the last option is to file a chapter 7 bankruptcy.

I realize that this answer may not be entirely to your liking, and I regret being the bearer of information that you really don’t want to hear. But it would be unfair to you and unprofessional of me were I to provide you with anything less than truthful and honest information. I hope you understand.

Customer:

Are there no angencies other than the government that might offer help?

WebLaw :

You may try local churches and other charitable organizations. I am not aware of one in particular that will assist. Unfortunately there are a lot of people who are currently losing their homes

WebLaw :

so sorry you are in this situation

Customer:

Thank you, XXXXX XXXXX but this has been of absolutely no help to me. Certainly not worth $79 of my hard-earned money.
