trying to find out about michigan commercial property rental

Resolved Question:

trying to find out about michigan commercial property rental security deposit return. Looking to find out if residential rental laws and commercial rental laws are the same as far as the landlord has to contact you within 30 days of your leaving with list of damanges. if the landlord does not contact you within 30 days, he forfits his right to any of your security deposit.

Under Michigan law, residential security deposits are subject to extensive regulation.  In contrast, there are no corresponding restrictions on security deposits for commercial leases or rules regarding the return.  In fact, commercial landlords can even require an “evergreen” security deposit that requires the tenant to replenish the security deposit if the landlord applies a portion of it to cure a tenant’s damage or default.

So.....what you are saying is there is no specified time frame that the landlord has to contact you about security deposit return, as in residental rental law of 30 days? Then what is a reasonable amount of time to wait for a response? There has to be some kind of law for this, people cant wait forever. my deposit is over small claim amount so it will be costly to take him to court to get my return. any suggestions????

Unless the lease provides otherwise, are limited to suing in the court after you make a written demand. If the lease provides, you may be able to recover attorney fees.

You can assume 30 days would be a reasonable time after the premises is vacated.
