I have been served with a summons by the Court with a foreclosure notice on investment property. I don'tobject to the foreclosure but need to respond to the Court. What language should I use toindicate that I can't make payments & do not object to the foreclosure?
Thank you for contacting us for guidance. There is no reason to respond to the summons and complaint as your failure to do so within the alotted amount of time will allow the lender to obtain a default judgment against you. This would be the same result if you filed and answer without denying any of the allegations and asserting no defenses. Please let me know if you need clarification.
