Answer

The statute of limitations for these offenses is the same as the underlying crime, or the most serious underlying crime.

For example, attempted murder or conspiracy to commit murder would have the same statute of limitations as murder.

If you would like information with regard to a particular underlying crime, just let me know and I will give you the statute of limitations.

what is the limitations of the crime there was no murder involved are you saying there is no statue of liminations on code 12.03? I read in Austin criminal defense Lawyer (d) Except as otherwise provided by this chapter, any offense that bears the title "aggravated" shall carry the same limitations peeriod as the primarycrime what does primary crime mean?

Answer

Well... "Aggravated" "Conspiracy" "Attempt" etc, aren't crimes in and of themselves. There must be another associated crime. For example aggravated assault, aggravated battery, conspiracy to commit battery, etc.

The primary crime is the second part, "assault" or "battery" in the examples I've given.

Aggravated is just an elevated type of a crime. Conspiracy is an agreement to commit a crime. Aggrevated by itself is nothing and you can't conspire to do something that is not a crime. Does that make sense now?

no it does not make sense now. what is the limitation time?

Answer

The limitation is the same as the primary crime.

If the primary crime is theft, the limitation is 5 years.

If the primary crime is forgery, the limitation is 10 years.

If the primary crime is murder there is no limitation.

I NEED TO KNOW WHAT THE PRIMARY CRIME IS TO TELL YOU WHAT THE LIMITATION IS, BECAUSE THE LIMITATION FOR AN AGGRAVATED CRIME, ATTEMPT, OR CONSPIRACY IS THE SAME AS THAT FOR THE PRIMARY CRIME.
