Question

We were told we had the right to occupy a our new home, only to find out three weeks after we occupied our home, that the county failed to inspect our septic system and that we needed to vacate our home until it was complete. Does any jurisdiction have the right to resend an occupancy permit?

Hi XXXXXXXX. Thank you for asking your question on Just Answer. The other experts and I are working on your answer. By the way, it would help us to know:

-did they give you a vacate order or did they tell you that you shouldn't have been living there yet?

As it would be putting you on the street basically HOMELESS, they should be able to complete the inspection. They should be able to allow you to stay in the home pending the outcome of the septic inspection.

To your knowledge, are all systems functional?

Reply to jflaker's Post: They did not give us a vacate order. They did, however, post a notice on our door that any person occupying this property is doing so illegally. All systems are running perfectly. We fired the septic company as a result of them trying to cut corners and the inspector and the company owner are friends. Thus causing the issue. However, another inspector from the county did grant us occupancy, so to resend that order seems illegal. Yesterday they refused to grant us a temporary occupancy permit. Any advice would help!!

Answer

If the county provided you with a certicate of occupancy, they are responsible for the liability incurred as a result of their failure to perform due dilligence.

I would draft a letter to the county office copying everyone involved.
