Hello my friend was accused of a assault and battery class 1 misdameanor it has been 2 years since the event and now a warranty for his arrest came in the mail after 2 years he has had no contact with other person is there a statue of limitation? i am asking this question from Richmond,V.A.

Hello,

The statute of limitations for criminal prosecution is governed by HERE.

The Assault and Battery code is found HERE

The 18.2.57 is not an exception in the limitation rules, and therefore the prosecution must commence within one year of there being cause.
