Question

I am looking to install a pool, I have 10 foot easenet on my property. The building department says I can not build within 35 feet of this easement. There is a 10 foot set back as well. My question is how far from the easement can I build?

If the set-back requirement is in addition to the 35 feet rule, then 55 feet from the property edge. If the set-back is met by meeting the 35 feet rule, then 45 feet from the property line. The building department should be able to tell you if the set-back is included in the 35 feet rule. Let me know if you have other questions.

I am sorry but you misunderstood part of the question. first there is a 10' easement for a storm drain. As for the set back the city requires a 10' set back from the property line. The code does not discuss set back where a easement exist.

Is your question whether the setback is 10' from the property line, 10' from the easement, or 35' from the easement, or 45' (35' + 10') from the easement? Have you asked the inspector or building department about the setback? Usually they provide that information. Please get their answer in writing and keep a copy of it in case needed in the future.

The city code requires a set back of 10'for a swimming pool. The is also a 10' easement on the property line. The city told me I needed to stay 35' from the property line(where the easement starts) they can offer no reason for the 35' distance. My question is can they make up the law as they go and do I need to build 20'            (combination of easement and set back)or can I build 10'from the line (due to the fact that 10' will satasify the easement and the set back together). In addition the city building department has a reputation for being difficult.

Here is my pragmatic view of the situation: you can hire an attorney and fight the city to put the swimming pool 20' from the property line. That will be expensive and time consuming. If you can put the pool 35' from the line and live with it, that will be less expensive and less time consuming. It really depends on what is most important to you? I do not like recommending that people "roll over"; however, fighting the city in this issue may not be worth the trouble. I understand that the city might not be able to justify the 35' but if you can put the pool in that location and live with it, that will be the most simple solution, even though it might not be a satisfying solution. I still recommend getting the city's opinion in writing so that after the pool is in the ground, they cannot come back and change the rules.
