Question

I have a misdemeanor theft charge from 10/2000 that resulted in a failure to appear bench warrant. I just found out about all of this 2 weeks ago and I want to know if the statute of limitations has expired on this charge. The warrant has now been changed to a summons.

Hi,

Once you are charged there is no statue of limitations on this matter. I would recommend calling the clerk of courts and asking about the summons. If you need to appear I would recommend taking care of this asap. A misdemeanor theft charge is not a big charge and nothing to be really afraid of. The most common penalty is fines and community service. Sometimes you can look at probation but this is unlikely.
