Question

My father and his brother are trying to settle my grandfathers estate. They have set a price for the estate and have had an offer for more than the apprasied value of the land. My dad is ready to accept the offer, but my uncle has decided that he will not sell unless he gets the enitre road frontage to the property because it faces his house. Doing this will ruin the vaule of the property. What rights does my father have?

If both your father and uncle are owners of your grandfather's estate, your father has the legal right to force the sale of the property by filing a court petition for the partition of the property. This will be a court order forcing the sale of the property. Your uncle can raise the issue of wanting the entire road frontage at court, but if it will ruin the value of the property, the court will not grant his request to get the entire road frontage. Your father can ask for the partition sale by filing the petition while the case is still in probate, so that the court is the ultimate decision as to this issue. This type of lawsuit is complex, so it would be wise for him to hire an attorney to assist with the partition suit.
