Question

My boyfriend, who lived with me, recently relapsed on drugs. He has left behind: furniture;tools;clothing; a 1964 Chevy pickup in my driveway (that doesn't work, and has 6 month overdue tags); and various boxes. I would like them out, and have called and emailed him numerous times, to please make arrangements with me to take away. He was going to come this weekend, and didn't. I need these things gone, so I can move on. Do I legally need to store them for him, or can I box them and donate them? Also the truck, can I call it into the city as abandoned, and have towed?

Hi,

In order for the you to dispose of personal property you must follow certain guidelines. Or be held liable for the items.

1.a. Write a notice to him.


b. Write a notice to any other person whom you believe may be the owner of some or all of the abandoned property.

The notice must:

1) Give enough information about the property so that the possible owner can identify it.

2) Tell the tenet receiving the notice the place where the property may be claimed.

3) Give the tenet a deadline after which time the property cannot be claimed.

If you have not done this and he is requesting his property to be returned you will be required by law to return it other wise he can take you to court for recover and a judgment from your negligent duties. Under state law you have certain steps you must follow failure to do so can leave you liable.

As for the truck you have the right to report it to police as a abandoned vehicle since the tags are outdated.
