Can I make a Mark to Market filing for the year 2002 without a prior filing?

For instance;

Should I file an ammended 2001 return as my notification and if not, is there another way to make this declaration happen for the year 2002. (I qualify otherwisew just fine the only guestion is that prior years notice and I really need this to work)
